Section H: Intellectual Property Rights in Submitted Artwork and Unacceptable Artwork

Copyrighted and trademarked artwork belonging to other individuals or entities may not be used as artwork in products that we print unless you have the owner’s express permission to do so. We reserve the right to (i) request confirmation of such permission, and (ii) refuse the order if, in our sole discretion, it appears that the final product would violate applicable laws. We follow this policy because a failure to do so could result in legal action by the owner. Further, subject matter that is deemed by us to contain derogatory, inflammatory or objectionable remarks, images or symbols will not be accepted. Examples of this include derogatory, inflammatory or objectionable content about an individual or a group’s race, religion, national origin, physical attributes, sexual preference or content containing profanity or pornography.

Satisfaction Guarantee

THE SPORT SHIRT. backs our products with our complete Customer Satisfaction Guarantee. While we strive for perfection, any machine is subject to occasional malfunction. For that reason, all custom orders are subject to a 5% spoilage allowance, standard for the industry. In the event of spoilage greater than 5% but less than 20% of your order, we will offer a credit from your total price. In the highly unlikely event of spoilage greater than 20%, we will remake the spoiled percentage of the order.

Mockup Approval

All orders will have a mockup. Payment will be considered approval of proposed mockup. (lettering, colors, and placement) to be placed on goods. THE SPORT SHIRT is not responsible if the customer changes design (lettering, colors, and placement) approval design has been placed on goods.

Misprints / Artwork or Garment Mistakes

If there is a misprint caused by our company, we will reprint the order at our expense. The original goods will need to be returned before the company reprints the order.

Correct Shipping Address

Once we complete production of your order, we will ship it directly to the address you specify. We cannot be held responsible for delays in shipping caused by inaccurate address information, acts of nature, the misrouting of your package by DHL, FedEx, UPS, USPS, or undeliverable shipping addresses. We will ship the order to the address provided.

Legal Disclaimer

Due to the custom nature of the products we manufacture, all sales are final. Once production has begun, an order may not be canceled for any reason. THE SPORT SHIRT. does not issue refunds, nor do we offer credit for shirt spoilage of 5% or less. As mentioned previously, we will issue a credit for greater than 5% spoilage, up to 20%. We will remake spoilage greater than 20%. In the unlikely event that a legal dispute arises, it is agreed that the venue for such a dispute is New Haven County, USA. Should the dispute pertain to the illegal use of copyright or trademark infringements, you agree to defend the claim at your sole expense. You agree to pay any damages and costs assessed against Cetana Ventures, LLC DBA THE SPORT SHIRT. as a result of such a lawsuit or proceeding. You also agree to hold THE SPORT SHIRT. harmless in such a lawsuit or proceeding. All items displayed on this website containing corporate logos or registered trademarks are shown only to illustrate the reproduction capabilities of THE SPORT SHIRT. Purchase of merchandise from THE SPORT SHIRT DOES NOT in any way, shape or form grant you permission to reproduce logos, nor does it transfer, grant or lease ownership of any logos or trademarks to you.
